Acceptance of Terms

Each time you access or use Aetheris Automotive (“Aetheris”), you agree to be bound by these Terms of Use, as amended from time to time with or without notice. If you use a particular service on or through Aetheris, you will also be subject to any rules or guidelines applicable to those services, which are incorporated by reference into these Terms.

Our Service

All services provided by Aetheris are offered on an “as is” basis. We reserve the right to modify or discontinue any aspect of Aetheris or its services, including deleting your data, at any time without notice or liability. We accept no responsibility for timeliness, deletion, failure to store, inaccuracy, or improper delivery of any data or information.

Your Responsibilities

To use Aetheris, you must register on our site, provide truthful information when requested, and be at least thirteen (13) years of age or older. By registering, you agree to these Terms of Use as amended from time to time.

Pricing and Currency

All prices listed on the Aetheris Automotive website are in United States Dollars (USD) unless otherwise stated. Prices may/can be displayed in other currencies for convenience, but orders will be processed in USD. Your bank or payment provider may apply currency conversion rates and fees, which are your responsibility.

Privacy

All registration data and personally identifiable information are subject to our Privacy Policy.

Registration and Passwords

You are responsible for maintaining the confidentiality of your password and account details. You are responsible for all activities that occur under your account, whether authorized or unauthorized. You agree to notify us immediately of any unauthorized use of your account or password.

Your Conduct

You agree that you will not:

(a) Provide content or conduct yourself in any way that is unlawful, illegal, threatening, harmful, abusive, harassing, defamatory, vulgar, obscene, offensive, pornographic, or objectionable, including content infected with viruses or malicious code, or in any way that may give rise to civil or criminal liability or violate any applicable law.

(b) Impersonate or misrepresent your association with any person or entity or attempt to conceal the origin of any content you provide.

(d) Use Aetheris in any commercial manner involving junk mail, spam, chain letters, pyramid schemes, or unauthorized advertising without our prior written consent.

(e) Provide any content that infringes upon any local, national, or international law, including but not limited to laws relating to copyright, trademarks, patents, or trade secrets.

Third-Party Services

Goods and services of third parties may be advertised or made available through Aetheris. Any representations regarding products or services provided by third parties are governed solely by their policies. We are not liable for your dealings with third parties.

Indemnification

You agree to indemnify and hold harmless Aetheris, its subsidiaries, affiliates, directors, officers, employees, agents, contractors, advertisers, partners, and co-branders from any claims or demands, including reasonable legal fees, arising from your conduct or connection with Aetheris, your content provision, your breach of these Terms, or violation of any rights of another.

Disclaimer of Warranties

Your use of Aetheris and its services is at your own risk. All services are provided “as is”, and we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, virus-free, secure, accurate, or reliable. You acknowledge that any content or advice provided is used at your own risk and without liability to Aetheris.

Limitation of Liability

We shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses, resulting from:

(i) The use of or inability to use our services;
(ii) The cost of obtaining substitute goods or services;
(iii) Unauthorized access to or alteration of your data;
(iv) Statements or conduct of any third party on the service;
(v) Any other matter relating to the service.

Reservation of Rights

We reserve all rights, including but not limited to copyrights, trademarks, patents, and trade secrets associated with Aetheris, its content, and services. No rights are granted to you except as expressly stated. Commercial use of Aetheris requires our prior written consent.

Notification of Copyright Infringement

If you believe your intellectual property rights have been infringed, please contact us immediately.

Applicable Law

These Terms are governed by and construed in accordance with the laws of South Australia, Australia, without regard to conflict of law principles. By using Aetheris, you submit to the exclusive jurisdiction of the courts of South Australia.

Miscellaneous

(i) If any provision of these Terms is held invalid, it will be interpreted to reflect the original intent, and the remainder will remain valid.
(ii) Failure to assert any right does not constitute a waiver of such right.
(iii) Any claim or cause arising out of your use of Aetheris must be filed within one (1) year or it will be forever barred.
(iv) We may assign our rights and obligations under these Terms without notice.
(v) Not all products sold are suitable for road use. It is your responsibility to confirm legality with local regulatory bodies. Products will not be accepted for return due to non-compliance with local regulations.
(vi) All products carry the full manufacturer’s warranty. Some manufacturers exclude coverage for competition or off-road use. If using products in competition, confirm warranty eligibility with Aetheris or the manufacturer prior to purchase.

Memberships and Subscriptions

Overview

Aetheris Automotive offers paid memberships providing access to exclusive benefits, including trade-level discounts, priority shipping, and additional features. By purchasing a membership, you agree to be bound by these Terms of Service and the Membership Policy, which is incorporated herein by reference.

Billing and Renewals

Memberships are billed in advance on a recurring basis according to your selected billing cycle (monthly or annual), and will automatically renew at the end of each billing period unless cancelled by you prior to renewal.
You authorize Aetheris to charge your nominated payment method for all applicable membership fees, including renewals, until cancellation.

Cancellation and Refunds

Memberships can be cancelled at any time via your account dashboard or by contacting Aetheris customer support.
Upon cancellation, your membership will remain active until the end of the current billing period.
No refunds or partial credits are issued for unused membership periods.

Changes to Membership Terms

Aetheris reserves the right to modify membership inclusions, pricing, or terms at any time. Changes will be communicated via email or your account dashboard. Continued use of the membership after such changes constitutes your acceptance of the modified terms.

Non-Transferability

Memberships are personal to the registered user and cannot be assigned or transferred to any other individual or entity without prior written consent from Aetheris.
